For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- for Anticipatory Bail in Crime No.876 of 2020 on the file of the respondent police.
ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent. 1/3
2.The learned counsel appearing for the petitioners seeks leave to withdraw this petition as regards the petitioner Nos.5 to 7. This Criminal Original Petition is dismissed as withdrawn as regards the petitioner Nos.5 to 7.
3.The petitioner Nos.1 to 4 apprehending arrest at the hands of the respondent police for the offences punishable under sections 448, 294(b), 323, 324, 506(ii) IPC and Section 4 of TN Prohibition of Harassmnet of Women Act, 2002, in Crime No. 876 of 2020 on the file of the respondent police, seek anticipatory bail. 4.It appears that the son of the fourth petitioner fell in love with the daughter of the de-facto complainant and their marriage was solemnized behind the petitioners back. That is the cause of the said occurrence. The petitioners through his counsel gives an undertaking that they will not interfere with the life of the newly married couple. I make it clear that if this undertaking is breached, this Court will not hesitate to cancel this anticipatory bail.
5.Recording the undertaking given by the petitioners, I am inclined to grant anticipatory bail to the petitioner Nos.1 to 4 with certain conditins. Accordingly, the petitioner Nos.1 to 4 are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Pattukkottai, Thanjavur District, and each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner Nos.1 to 4 shall appear before the respondent police as and when required for interrogation. The petitioner Nos.1 to 4 shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
6. The petitioner Nos.1 to 4 shall appear before the concerned Magistrate within a period of eight(8) weeks from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
