: Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents herein to run the ration shop situated in the building in S.No.157/9 Narangiyampatti Village, Minnathur Post, Kulathur Taluk, Pudukkottai District as usual on the basis of the representation dated 12.05.2020 given by the petitioner.

[Order of the Court was made by P.N.PRAKASH, J.] The petitioner has filed the present Writ Petition seeking a direction to the respondents herein to run the ration shop situated in the building in S.No.157/9, Narangiyampatti Village, Minnathur Post, Kulathur Taluk, Pudukkottai District as usual, on the basis of the petitioner's representation dated 12.05.2020. 1/3

2. We heard Mr.B.Jameel Arasu, learned counsel for the petitioner over video-conferencing. We also heard Mr.R.Sethuraman, learned Special Government Pleader for the respondents.

3. Mr.Mani, Taluk Supply Officer of Kulathur Taluk, Pudukkottai District, came on audio link. On written instructions, Mr.R.Sethuraman, learned Special Government Pleader submitted that the ration shop is now functioning in the premises belonging to the petitioner herein, who belongs to a particular community. Attached to the said ration shop, there are 48 card holders of the community to which Mr.Tamilselvan, the petitioner herein belongs. Apart from that, there are 160 card holders of another community. It is alleged that there is communal strife between these two communities, on account of which, the members of the other community are unable to buy rations from the present shop. That apart, an F.I.R. has been registered in Udayallipatti Police Station Crime No.

37 of 2020 under Sections 147, 294(b), 323 and 427 of the Indian Penal Code, in which, the petitioner is an accused. This case relates to violence against the other community members. In such view of the matter, the prayer of the petitioner cannot be considered and this Court cannot interfere into the administrative decisions of the authorities to shift the ration shop.

4. In the result, this Writ Petition is devoid of merits and accordingly, the same is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
