PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, to direct the District Munsif Court, Kuzhithurai to dispose of the E.A.No.1 of 2023 in E.P.No.2 of 2015 in O.S.No.389 of 1979, pending on the file of the Principal District Munsif Court, Kuzhithurai within a stipulated time as fixed by this Court.

O R D E R

The defendants 112, 113 and 114 in O.S.No.389 of 1979, on the file of the District Munsif Court, Kuzhithurai, have filed the present Civil Revision Petition seeking expeditious disposal of E.A.No.1 of 2023.

2. A perusal of the records reveal that the above said suit has been filed for the relief of demarcation of boundaries. When the suit has been decreed as prayed for, the decree holder has filed E.P.No.2 of 2015, to execute the decree. Pending execution proceedings, 84th respondent had passed away and E.A.No.1 of 2023 has been filed to implead the legal heirs of the deceased 8/11

party. They have also entered appearance through their counsel. However, the application is being adjourned from time to time for filing counter. Hence the present Civil Revision Petition has been filed.

3. Considering the fact that the proposed parties have already entered appearance in E.A.No.1 of 2023 and the suit is of the year 1979, the trial Court is directed to dispose of E.A.No.1 of 2023 on or before 31.07.2025 and thereafter, the execution petition in E.P.No.2 of 2015 shall be disposed of on or before 30.11.2025.

4. With the above said observations, this Civil Revision Petition stands disposed of. There shall be no order as to costs. 21.04.2025 NCC : Yes/No Index : Yes / No Internet : Yes / No ebsi 9/11
