ORDER

This writ petition has been filed seeking for a direction to the 1st and 2nd respondents herein to conduct proper enquiry and dispose the petitioner's complaint / representation dated 10.09.2025 within a stipulated period as may be fixed by this Court.

The learned counsel appearing for the petitioner submitted that the petitioner is the defacto complainant, who had lodged a complaint as against the third respondent with respect to the manner in which he was defrauded by the 3rd respondent to the tune of Rs.13 Lakhs. However, there is no progress in the investigation by the respondent police. Hence this writ petition came to be filed.

3. The learned Government Advocate appearing for the respondent police submitted that, as per the complaint given by the petitioner, the third respondent had received money from the petitioner for obtaining permission to run an E-Seva Centre. Since there is a money dispute between the parties, the petitioner has been directed to appear before the respondent police and furnish particulars regarding the mode of transaction with the third respondent. further submitted that the enquiry will be concluded within the stipulated time.

3. Heard the learned counsel on either side and carefully perused the materials placed before this Court. Since no adverse order is proposed to be passed against the third respondent, notice to him is dispensed with.

4. Considering the facts and circumstances of this case, the respondent police is directed to issue summons to the petitioner and the third respondent under Section 64 of BNSS, 2023 and conduct proper enquiry and conclude the same within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition stands disposed of. 05.03.2026 NCC : Yes / No Index : Yes / No Sm 3/4
