ORDER

This petition has been filed for issuance of Writ of Mandamus, directing the respondents to take appropriate action against the complaint mentioned Sirilrayapan, who has stolen and using petitioner's Honda Amaze Car bearing Registration No.TN 37 CS 4447 for illegal purpose without handed over to the petitioner and against the officials or authorities, who has not taken proper appropriate action on petitioner's complaint dated 19.08.2025, 24.09.2025 and 05.02.2026 respectively and conduct proper investigation and enquiry and take appropriate action to recover the petitioner's car.

2.The petitioner's car was allegedly mortgaged to one Sirilrayappan by the petitioner's son. The said person has refused to return the same. The petitioner's son had earlier preferred a complaint, which was closed. Subsequently, the petitioner also preferred a complaint and the same was closed. The contention of the petitioner is that the alleged mortgage is false and that neither he nor his son ever mortgaged the car to the said Sirilrayappan.

3.Therefore, the respondent is directed to re-open the enquiry and conduct the re-enquiry, after calling the petitioner as well as the Petitioner's son. The petitioner is directed to produce the relevant records to the second respondent Police. The above said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. If any criminal offence is made, the respondent shall register an FIR.

4.With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
