: Respondent PRAYER: Writ Appeal is filed under Clause 15 of the Letters Patent against the order of a learned Single Judge of this Court dated 08.11.2013, made in W.P.(MD).No.17849 of 2013. For Appellant : Mr.A.Thirumurthy For Respondent : Mr.VR.Shanmuganathan, Special Government Pleader
JUDGMENT
[Judgment of the Court was delivered by R.SUBBIAH, J.] The present Writ Appeal has been filed as against the dismissal of the Writ Petition filed by the appellant herein, by order dated 08.11.2013, made in W.P.(MD).No.17849 of 2013.
2. The case of the appellant before the learned Single Judge was that he appeared in the written competitive examination for direct recruitment of Post Graduate Assistant for Physical Education Director Grade-I, for the year 2012-2013 in Economics Subject. In the written examination, he has secured 96 marks. The cut-off mark is 98. In this Writ Petition, he has challenged the Key answers for the question Nos.41 and 88 in 'A' series. Apart from the above, the appellant has challenged the noninclusion of the weightage mark for the purpose of short listing the candidates for certificate verification. The short listing for certificate verification is based on merits viz., the marks secured in the written examination. The question of including the weightage mark even before certificate verification does not arise. By observing so, the Writ Petition was dismissed by the learned Single Judge, by order dated 08.11.2013 and hence, the present Writ Appeal. https://hcservices.ecourts.gov.in/hcservices/
3. In the appeal, it is the contention of the learned counsel for the appellant that though the appellant had given a proper answer to the
question No.41, no proper mark was given for the same.
4. However, today, when the matter was taken up for consideration, the learned Special Government Pleader submitted that since the said question itself was wrong, it was deleted and hence, the same was not taken into consideration for awarding mark.
5. In view of the submission made by the learned Special Government Pleader, we find that nothing survives for adjudication in the present Writ Appeal. Hence, the Writ Appeal is closed. No costs. Consequently, the connected miscellaneous petition is also closed.
