ORDER
This petition is filed to relax the condition imposed in Crl.M.P.(MD)No.7814 of 2024 in Crl.A.(MD)No.636 of 2022, by order dated 05.08.2024.
2. This Court, while suspending the sentence on 28.03.2024 in Crl.M.P.(MD) 1/3
No.3362 of 2024, directed the petitioner to appear before the learned Special Judge for Exclusive Trial of POCSO Act Cases, Thanjavur, daily at 10.30 a.m. and 5.30 p.m. till the disposal of the appeal. Subsequently, on the petition filed by the petitioner in Crl.M.P.(MD)No.7814 of 2024, this Court, by order dated 05.08.2024, modified the condition to the effect that the petitioner shall appear before the concerned Court, once in a week, i.e. every first working day of the week at 10.30 a.m. until further orders. Now, this petition is filed seeking to relax the said condition.
3. The learned counsel appearing for the petitioner submits that the petitioner is regularly complying with the condition for the past six months. Further, the petitioner has not created any problem to the victim.
4. Ms.P.Vidhya, Police Constable in All Women Police Station, who is present before this Court, has also confirmed that the petitioner has not created any problem to the victim.
5. Considering the fact that the petitioner is regularly complying with the condition for the past six months and he has not created any problem to the victim, this Court is inclined to modify the condition imposed in Crl.M.P.(MD)No.7814 of 2024.
6. Accordingly, this Criminal Miscellaneous Petition is allowed and the condition is modified to the effect that the petitioner shall appear before the trial 2/3
