PRAYER: Petition filed under Section 482 of Code of Criminal Procedure, to direct the second respondent not to harass the petitioner.

ORDER

The petitioner is the employer of the third respondent. 2.It appears that the third respondent is no longer in service. The circumstance under which the third respondent left the service are not gone into.

3.The petitioner's counsel would state that the third respondent is unauthorisedly absent. Certain issues have arisen regarding the return of certificates of the third respondent. 4.The petitioner's counsel would state that most of the certificates have been returned and only two certificates got misplaced during transit.

5.I do not want to go into the merits of the contentions. I am of the view that interest of justice will be served by issuing the following directions:- (I) The second respondent will issue summons in writing, if he wants to enquire the petitioner. There cannot be any oral summon for attending enquiry.

(II) If the second respondent registers any FIR, the petitioner will be given due notice, so that, the petitioner will https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.5693 of 2020 have breathing time to move the concerned Court for the relief of anticipatory bail.

6.With this direction, this Criminal Original Petition is disposed of.
