Respondents PRAYER: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus, praying for a direction to the 2nd respondent herein to produce the body or person of the petitioner's husband namely, N.Venkatesh, aged 49 years, before this Court and set him at liberty. ORDER

[Order of the Court was made by S.NAGAMUTHU, J] The petitioner is the wife of one Mr.N.Venkatesan, aged about 49 years. According to the petitioner, the detenu has been found missing from 01.05.2015 onwards. In this regard, a case has been registered in Crime No.140 of 2015 and same is under investigation.

2. We have heard the learned counsel appearing for the petitioner, the learned Additional Public Prosecutor appearing for the respondents and we have also perused the records carefully. https://hcservices.ecourts.gov.in/hcservices/ 3.The learned counsel for the petitioner would submit that

though the case was registered, the detenue has not been secured by the second respondent.

4. The learned Additional Public Prosecutor would submit that the investigation is taken a right direction and every possible steps are taken by the second respondent to secure the detenu.

5. Considering the above facts, since there is no allegation of illegal detention, we are inclined to dismiss this petition as no direction could be needed. Accordingly, this Habeas Corpus Petition is dismissed.
