ORDER

Seeking direction to the second respondent police to afford adequate polic protectin for the petitioner by considering his representation dated 06.01.2026, this criminal original petition is filed.

2.Since no adverse order is going to be passed against the third respondent, notice to him is dispensed with.

3.The learned counsel for the petitioner submitted that the petitioner had married his daughter to the third respondent, within whom, indifference had crept in, following which, they got a decree of divorce vide order dated 19.09.2025 made in FCOP No.226 of 2020 passed by the learned Judge, Family Court, Erode. During the pendency of FCOP, the petitioner's daughter has filed an application in I.A.No.3 of 2022 seeking return of her Srithana articles, including jewelry and the same was ordered an ex-parte (docket order). In this regard, several disputes have erupted between the parties, following which, the third respondent is threatening the petitioner with dire consequences, since the petitioner's daughter is working in abroad. Therefore, the petitioner has filed the present petition seeking aforesaid prayer. 4.The learned Additional Public Prosecutor submitted that it is all a matrimonial dispute and they have received a complaint as against the third respondent.

5.Heard either side and carefully perused the materials available on record.

6.Considering the submissions made, the second respondent police is directed to put the petitioner as well as the third respondent on notice under Section 64 of BNSS and require the petitioner as well as the third respondent to appear before them and thereafter, take necessary action in the manner known to law. If the petitioner's requirement seeking police protection is found to be true, then the second respondent shall afford necessary police protection on payment of necessary fees in terms of G.O.(Ma).No.139, Home (Pol-VIII) Department, dated 04.03.2019 by the petitioner. 7.With the above directions, this Criminal Original Petition is disposed of.
