Prayer:- CRL OP(MD)838 of 2022 Criminal Original petition filed under section 439(1)(B) of Cr.p.c. To modify the condition imposed by the Hon'ble Judicial Magistrate NO.I Court, Kumbakonam in Crl.M.P.No.4018 of 2021 dt 22/10/2021 to appear before the Respondent Police, EOW-II Trichy, till further orders, may be Modified by this Honourable Court and Relaxed the condition to appear as and when required Court by the Respondent Police in line of the common order dt 11.11.2021 by this Honourable and thus render justice.
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.Karthick Advocate for the Petitioner and of Mr.R.Sivakumar Government Advocate for the respondents, this Court made the following order: This petition has been filed to relax the condition imposed against the petitioner in Crl.O.P(MD)No.838/2022, dated 16.02.2022. 2.The learned counsel for the petitioner would submit that the petitioner is complying with the condition regularly. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Government Advocate (Criminal Side) appearing for the respondent Police would submit that the petitioner is complying with the condition regularly. He would further submit that since the investigation is pending.
4. Considering the above, the petitioner is directed to appear before the respondent police weekly once i.e., on every Monday at 10.00 am., until further orders.
5.The petition is ordered accordingly.
