PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to direct the Special Court for Schedule Caste and Schedule Tribes (Prevention of Atrocities) Act, II Additional Sessions Judge (PCR), Tirunelveli, Tirunelveli District to accept the surrender of Petitioners and consider his bail application on merits, in accordance with law and grant 1/5
bail as on the same date of surrender itself in connection with the case in Cr.No.39 of 2024 registered on 11.03.2024 on the file of the second Respondent Police.

O R D E R
The learned Counsel for the Petitioner submitted that the Petitioners are arraigned as A1, A2, A4 and A5 in Cr.No.39 of 2024 pending on the file of the second Respondent. The Petition had been filed seeking a direction against the learned II Additional Sessions Judge (PCR), Tirunelveli, Tirunelveli District, to accept the surrender of the Petitioners in Cr.No.39 of 2024 and to consider the bail application on such surrender. 2.The learned Government Advocate (Crl.side) on instructions of the Respondent Police submitted that the Petitioners herein are alleged to have attacked the relative of the third Respondent/de-facto Complainant, when he had advised the Petitioner to go slow. It is his further submission that A1 2/5
has got two previous cases and A2 has got one previous case. The relative of the third Respondent/de-facto Complainant was in hospital for three days and he was suffered injury in his lips as well as on the chin. 3.Considering the submissions made by the learned Government Advocate (Criminal Side) and the learned Counsel for the Petitioners, this Court directs the Petitioners to surrender before the l learned II Additional Sessions Judge (PCR), Tirunelveli, Tirunelveli District, within 15 days from the date of receipt of a copy of this order or from the date of uploading the copy of this order on the official web-site of this Court. 4.On such surrender by the Petitioner and on filing an application for bail, the learned II Additional Sessions Judge (PCR), Tirunelveli, Tirunelveli District, shall consider the bail application of the Petitioners, after issuing notice to the victim of crime /de-facto Complainant. After hearing the objections of the victim of the crime, shall pass appropriate orders as per law.
