PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, to punish the Contemnor/ Respondents 1 to 3 for willfully disobeying and not complying with the order passed by this Court in W.P(MD)No.4640 of 2021, dated 30.06.2022.

ORDER

This is a petition seeking initiation of contempt proceedings against the Respondents for violation of the order, dated 30.06.2022 passed by the Writ Court in W.P.(MD)No.4640 of 2021.

2. Heard Ms.A.Amala, learned counsel for the Petitioner and Mr.R.Baskaran, learned Additional Advocate General, assisted by, Mr.F.Deepak, learned Special Government Pleader for the Respondents, who accepts notice on behalf of the Respondents. 2/8

3. When the matter was taken up on 22.04.2025, this Court passed the following order:

2. Mr. R. Baskaran, learned Additional Advocate General, assisted by Mr. F. Deepak, learned Special Government Pleader for the Respondents, produced the Government Order in G.O. (2D) No. 06, Higher Education (E2) Department, dated 21.04.2025, and the proceedings of the Joint Director of Collegiate Education, Madurai Region, Madurai, dated 22.04.2025. The said proceedings state that under the relevant chapter of the Grant-in-Aid Code and the cited G.O., the Joint Director of Collegiate Education, Madurai Region, Madurai, sanctions payment of salary grant to the Fatima College, Madurai, in the current financial year 2025-2026. The copies of the Government Order and the proceedings of the Joint Director of Collegiate Education, are taken on record.

3. Mr.R.Baskaran, learned Additional Advocate General, submits that the Government sanctioned the Petitioner's arrears of salary for the period from 13.02.2017 to 31.12.2022, amounting to Rs. 3/8

53,90,480/-, vide G.O. (2D) No. 06, Higher Education (E2) Department, dated 21.04.2025.

4. Mr.R.Baskaran, learned Additional Advocate General, further submits that if the Petitioner submits the pay bill to the Respondents, the amount shall be credited to the account of the incumbent forthwith, within a period of three days from the date of receipt of the pay bill.

5. Put up this case on 29.04.2025 "for further orders" before this Court.

6. Let a copy of this order be given to Mr.R.Baskaran, learned Additional Advocate General, for its necessary compliance and information to the Respondents..

In compliance with the order passed by this Court dated 22.04.2025 in the present Contempt Petition, Mr.R.Baskaran, learned Additional Advocate General, assisted by, Mr.F.Deepak, learned Special Government Pleader for the Respondents, submits that the amount to the tune of Rs.53,90,480/- (Rupees Fifty Three Lakhs Ninety Thousand and Four Hundred Eighty only) has been credited to the account of the incumbent, viz., A.Sarpiya Rani. Thus, the Respondents have fully complied with the 4/8

judgment and order passed by the Writ Court dated 30.06.2022 in W.P.(MD)No.4640 of 2021. Therefore, he prays that the Respondents be discharged from the contempt proceedings.

Ms.A.Amala, learned counsel for the Petitioner, submits that the incumbent, viz., A.Sarpiya Rani has received the amount to the tune of Rs.53,90,480/- (Rupees Fifty Three Lakhs Ninety Thousand and Four Hundred Eighty only) and submits that the Respondents have fully complied with the judgment and order passed by the Writ Court dated 30.06.2022 in W.P.(MD)No.4640 of 2021 as well as the directions issued by this Court dated 08.04.2025 and 22.04.2025 in the present Contempt Petition. The learned counsel further states that she has no objection to the Respondents being discharged from the contempt proceedings.

6. Considering the submissions made by the learned counsel for the Petitioner and the learned Additional Advocate General for the Respondents, and upon perusal of the records, this Court is satisfied that the Respondents have fully complied with the judgment and order of the 5/8

Writ Court dated 30.06.2022 passed in W.P.(MD)No.4640 of 2021 as well as the directions issued by this Court in the present Contempt Petition dated 08.04.2025 and 22.04.2025. In view of the same, this Court deems it appropriate that no useful purpose would be served by keeping the contempt proceedings pending. Therefore, the Respondents are discharged from the contempt proceedings.

7. In view of the above, the Contempt Petition is disposed of. The file shall be consigned to record. There shall be no order as to costs. 29.04.2025 NCC:yes/no Index:yes/no Internet:yes/no Nsr 6/8
