ORDER
The petitioner approaches this Court with a prayer to direct the 3rd and 4th respondents not to harass the petitioner and his family members under the guise of enquiry and not to interfere in the family dispute of the petitioner.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the State and also perused the materials available on record.
3. The learned counsel appearing for the petitioner would submit that the fifth respondent is the wife of the petitioner and against her, the petitioner has also filed a petition for divorce and it is yet to be numbered and she is repeatedly approaching various police stations and lodged false complaints against the https://hcservices.ecourts.gov.in/hcservices/
petitioner and based on which, the petitioner is being summoned by the respondent police under the guise of enquiry and he is being harassed by them and hence, prays for appropriate orders.
4. Per contra, the learned Government Advocate(Crl. Side) appearing for the State on instructions would submit that the complaint given by the fifth respondent was taken on file in C.S.R.No.441 of 2016 by the fourth respondent police and appropriate advise has been given to work out their remedy before the competent civil Court and as on today, no complaint/petition is pending before the third as well as the fourth respondents.
