PRAYER: Review Application is filed under Section 114 and Order XLVII Rule 1 & 2 of the Code of Civil Procedure, 1908, to review the order in WP(MD)No.20679 of 2023 dated 17.12.2025 and allow the writ petition. ORDER

The petitioner an employee of the 3rd respondent society has filed a writ petition in WP(MD)No.20679 of 2023 with a grievance that though he retired from service on 30.06.2023, the benefits due to him were not settled by the respondents.

2.When the writ petition was taken up for hearing on 17.12.2025 a representation was made on behalf of the respondent society that the benefits due to the petitioner were settled. Recording the submission made on behalf of the society, the writ petition filed by the petitioner was closed by order dated 17.12.2025.

3.Now the petitioner has filed this present review application that a wrong representation has been made before this court in WP(MD)No.20679 of 2023 and that the terminal benefits due to the petitioner have not been settled. 4.In view of the submission made by the petitioner this court has directed the learned Additional Government Pleader to get instructions. 5.The learned Government Advocate appearing for the respondent society submits that from the terminal benefits due to the petitioner a sum of Rs.24,74,534/- was settled to the petitioner on 16.12.2025. However he fairly admits that there is some due to be paid to the petitioner and it would be settled within six months.

6.The learned counsel appearing for the review applicant admits the receipt of Rs.24,74,534/- on 16.12.2025. According to him a sum of Rs.2,90,228/- is yet to be paid.

7.This court has considered the rival submissions made. 3/6

8.It appears that a substantial amount has been paid by the respondent society to the petitioner on 16.12.2025 and this court has disposed of the writ petition on 17.12.2025. The review applicant claims that a sum of Rs.2,90,228/- is yet to be settled.

9.Considering the above submissions, this court directs the 3rd respondent to verify and pay the balance amount, if any, due to the petitioner within a period of six months from today.
