Palaniyammal v. The District Collector
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 01.09.2023
CORAM:
THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN Palaniyammal ... Petitioner Vs.
1.The District Collector, Madurai District, Madurai.
2.The Commissioner, Usilampatty Panchayat Union, Usilampatty, Madurai.
3.The Chairman, Usilampatty Panchayat Union, Usilampatty, Madurai. ... Respondents PRAYER: Petition filed under Order 47 Rule 1 & 2 r/w Section 114 of C.P.C., praying to review the order passed in W.P.(MD)No.894 of 2023, dated 14.02.2023.

For Petitioner : Mr.R.Murali For Respondents : Mr.N.Satheesh Kumar Additional Government Pleader for R1 : no appearance for R2 & R3
ORDER
Heard the learned counsel on either side.
2. The petitioner had taken part in the auction and paid a handsome amount. Subsequently, he developed cold feet. He complained that even without putting up proper infrastructural facilities, auction was conducted. The petitioner obviously had taken part in the auction with his eyes wide open. I therefore concluded that the question of directing the respondents to refund the amount does not arise. Aggrieved by the said order, the present review application came to be filed.
3. After a careful consideration of rival contentions and going through the materials on record, I am more than satisfied that there is no error apparent on the face of the record warranting review. It is open to the petitioner to adjudicate before the jurisdictional civil court or avail any other remedy under law. The dismissal of the writ petition will not 2/4
come in the way.
4. With this observation and liberty to the petitioner, the review application is dismissed.
