ORDER : The Court Made the following order :- The petitioner is arrayed as accused No.5, who was arrested and remanded to judicial custody on 29.07.2016 for the alleged offences punishable under Sections 8(c) r/w 20(b)(ii)(C) & 25 of NDPS Act, in Crime No.53 of 2016, on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that on information, the respondent police went to Kamuthi and they seized 130 kgs of ganja and the respondent police arrested the first and second accused. As per the confession statement of the first and second accused, the case has been registered against him.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. The petitioner is in judicial custody from 29.07.2016.
4.The learned Government Advocate (Crl. side) submitted that 130 kgs of ganja was seized, which is commercial quantity and the petitioner is also having bad antecedents and the investigation is pending. If the petitioner is released on bail, he will tamper the evidence and hamper the investigation.

5.Considering the nature and gravity of the offence and the contraband was seized is commercial quantity, this Court is not inclined to grant bail to the petitioner and accordingly this Criminal Original Petition is dismissed.
