ORDER
This Criminal Original Petition has been filed to modify the condition No.(i) imposed on the petitioners vide order dated 31.01.2024 in Cr.M.P.No.551 of 2024 on 1/3
the file of the learned Principal District and Session Judge, Virudhunagar District, Srivilliputhur.
2.The learned counsel appearing for the petitioners would submit that the learned Principal District and Session Judge, Virudhunagar, granted anticipatory bail to the petitioners in Cr.M.P.No.551 of 2024 vide order dated 31.01.2024 with a condition that the petitioners shall deposit a sum of Rs.1,50,000/- before the Judicial Magistrate, Thiruchuli, in Crime No.32 of 2024 of Thiruchuli Police. Due to poverty, the petitioners are unable to pay the amount before the concerned Judicial Magistrate. Hence, this Petition has been filed.
3.The learned Government Advocate (Crl.side) appearing for the respondent Police would submit that the Court below, after considering all aspects, has rightly imposed the condition on the petitioners.
4. Considering the facts and circumstances of the case and the fact that the properties damaged by the accused persons are worth about Rs.3,00,000/-, the trial Court has rightly imposed the aforementioned condition on the petitioners that they shall deposit a sum of Rs.1,50,000/- before the concerned Judicial Magistrate in Crime No.32 of 2024, which does not warrant any interference by this Court. 2/3
