Writ Petition is filed under article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to transfer the property tax to the petitioner's name viz Siva Subramanian and the petitioner's brother Bhagavathy's name for the property situated at No.7A, Brammasanthi Street, Panagudi, Tirunelveli District within a stipulated period as fixed by this court.

ORDER

This writ petition is filed with a prayer directing the respondent to transfer the property tax to the petitioner's name as Siva Subramanian and his brother Bhagavathy, in respect of the property situated at No.7A, Brammasanthi Street, Panagudi, Tirunelveli District. 2.Upon hearing the learned counsel for the petitioner and perusing the material records of the case, when the property was bequeathed to the petitioner and his brother by way of Will, while describing the property instead of mentioning it as 7A, in Tamil it was mentioned as 7 a[. 3.In view of such discrepancy, even though the application is made by the petitioner, till date the mutation is not effected, even though the Will has come into force and there is no other dispute whatsoever with reference to the Will.

4.When the matter is came up for hearing today, the learned Government Advocate takes notice on behalf of the respondent would submit that if the documents are produced before the authorities, the respondent will consider and effect the necessary mutation in accordance with law.

5.In view thereof, this Writ Petition is disposed of with the following terms:

(1)Within one week from the date of receipt of the web copy of the order, the petitioner shall appear before the respondent and produce the original document if it is in possession or duly a certified copy. (ii)Upon production of the copies of the Will, death certificate etc., the second respondent shall forthwith effect the mutation, not withstanding the fact that the property description has been wrongly mentioned as 7( a[ ) [provided there is no other impediment or difficulty in the matter. The exercise shall be carried on within a period of four weeks from the date of receipt of the appearance of the petitioner before the respondent.
