ORDER

Seeking to direct the respondents not to harass the petitioner and his family under the guides of enquiry, this writ petition is filed.

2. The learned counsel for the petitioner submitted that he is unnecessarily subjected to harassment by the respondent police in the name of bad criminal antecedents.

3. The learned Additional Public Prosecutor submitted that the petitioner is a history sheeter, against whom 9 previous cases were registered, among which one case is with regard to double murder, and history sheet is maintained against the petitioner in H.S.No.310 of 2014 on the file of the 2nd respondent police station.

4. Heard the learned counsels on either side and carefully perused the materials available on record.

5. Due to the advent of elections, across the State, the respondent police is taking effective steps to maintain the law and order. Since the 2/5

petitioner is a history sheeter in History Sheet No.310 of 2014 on the file of the 2nd respondent police station, the police had called the petitioner for enquiry. However, it is also brought to the notice of this Court that he is evading summons in C.C.No.709 of 2023 on the file of the Judicial Magistrate No.III, Nagercoil. The petitioner is directed to appear before the Judicial Magistrate No.III, Nagercoil. It is brought to the notice of the Court that already the petitioner had executed a bond on 05.10.2025 before the learned Executive Magistrate, Agastheeswaram ensuring to maintain good behavior for a period of one year. In view of the same, I do not find any necessity for the respondent police to further seek any bond till 06.10.2026. It is also made clear that that the petitioner should maintain his good behavior.
