PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 herein to conduct enquiry against the 3rd respondent herein and his associates within the time as stipulated by this Honble Court on the basis of the representations given by the petitioner dated 02.05.2024 and 17.05.2024.

This Writ Petition has been filed seeking a direction to the respondents 1 and 2 herein to conduct enquiry against the third respondent herein and his associates on the basis of the representations given by the petitioner dated 02.05.2024 and 17.05.2024. 2.According to the petitioner, he lodged a complaint against the 2/6
third respondent before the respondents 2 and 4 through representations, dated 02.05.2024 and 17.05.2024, but the same have not been considered. Hence this petition.
3.The learned Government Advocate appearing for the respondents 1 and 4 would submit that already the second respondent sought for the particulars of the third respondent and they furnished the same to the investigation agency.
4.The learned Additional Public Prosecutor appearing for the respondent police would submit that they are conducting the preliminary enquiry and the enquiry is pending. They have collected some particulars and also examined some witnesses. Therefore, they will complete the enquiry as early as possible without any delay. 5.The learned Counsel for the third respondent would submit that the allegations levelled against the third respondent are false and he is also ready for enquiry and will co-operate for the speedy enquiry. 6.Considering the prayer sought for in this petition and the second 3/6
respondent also conducting preliminary enquiry and the respondents 1 and 4 also furnished the required documents to the second respondent, it is for the second respondent to conduct a fair enquiry and to take appropriate action in accordance with law.
7.In view of the same, recording, the submission made on behalf of the second respondent, this Court directs the second respondent to complete the enquiry as early as possible without any delay in accordance with law.
