ORDER : The Court Made the following order :- The petitioners/accused Nos.1 to 4, were arrested and remanded to judicial custody on 23.11.2016 for the offences punishable under Sections 147, 148, 342, 324, 364, 307, 506(ii) and 302 of I.P.C., in Crime No.620 of 2016 on the file of the respondent police, seek bail.

2. The case of the prosecution is that on 22.11.2016 at about 7.00 p.m., Subbiah and his sons Premkumar and Ranjith Kumar were attacked by a gang Subbiah and Ranjithkumar were abducted following the attack, Subbiah was found dead whereas Ranjithkumar seriously injured.

3. According to the prosecution, the said occurrence took place due to money dispute between the petitioner and the deceased regarding engaging JCB for quarry.

4. The learned Government Advocate (Crl.side) submits that investigation has been completed and final report also filed and the case has been committed to Sessions Court and assigned as S.C.No.172 of 2017.

5. Considering the present status of the case, this Court is inclined to grant bail. Accordingly, the petitioners are ordered to be released on bail subject to the following conditions: https://hcservices.ecourts.gov.in/hcservices/

(i) the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.VI, Madurai;

(ii) the petitioners shall report before the concerned Sessions Court daily at 10.30 a.m. until further orders; (iii) The petitioners shall not abscond either during investigation or trial;

(iv) on breach of any of the aforesaid conditions, the Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioner released on bail by the Magistrate/Trial Court.
