PRAYER :- For Bail in Crime No.229/2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.4 herein, who was arrested on 05.03.2022 for the alleged offence under Sections 147, 148, 294(b), 363 and 397 IPC, in Crime No.229 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that on 04.03.2022 at about 07.00 p.m., the de-facto complainant along with A7 and A9 were in the farmhouse of the de-facto complainant, at that time, four or five persons came there and attacked the de-facto complainant with a broom stick and kidnapped the de-facto complainant in his Car bearing Registration No.TN-45-BS-7656 and demanded to pay one crore rupees and on the way they sent an amount of Rs.1.00 lakh from the Paytm account of the de-facto complainant to the fifth accused and they were sitting in a field, the present petitioner provided food and drinks to them and at about 01.00 a.m, they left that place and started the car and blindfolded the eyes of the de-facto complainant 1/3
and accused along with the de-facto complainant were coming near to Madurai, when the police was on search, on apprehension of seeing the police, one Srinath escaped from that place and A1 and A2 and the de-facto complainant were caught hold by the police. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner only providing food to the co-accused and on the ground that they are known to him and his friends and he is not involved in the above said occurrence as well as extortion of money. 4.The learned Additional Public Prosecutor submitted that the involvement of the petitioner is noted only with regard to the above said limited role of supplying food to the co-accused and after supplying food. It appears that the occurrence said to have taken place. He further submitted that the petitioner is not having any previous case.
5.Considering the period of incarceration and also considering the fact that the petitioner is not having any bad antecedents, this Court is inclined to grant bail to the petitioner with stringent conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magistrate, Srirangam, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 06/04/2022 / TRUE COPY / 06/04/2022 Sub-Assistant Registrar (C.S-II) Madurai Bench of Madras High Court, Madurai - 625 023.
