JUDGMENT
(Judgment of the Court was delivered by C.V.Karthikeyan, J.) The learned counsel for the appellant had filed the following memo:
"1. It is submitted that we are the counsel for the appellant. We have preferred this First Appeal AS(MD)No.47 of 2019 challenging the Judgment and decree made in OS.No.211of 2015 dated 28.04.2018 on the file of the Learned 5-Additional rict Court Madurai, It is submitted that as per instruction of my client aforesaid case arrived settled out of the Court and also the EP No.72 of 2020 were closed by the Plaintiff in the Learned 5-Additional District Court Madurai. Therefore the Hon'ble High court may pleased to refer the aforesaid First Appeal to the Lok Adalat and - render justice."
2. It is seen that the plaintiff had closed the E.P.No.72 of 2020, in view of the settlement reached between the parties. In view of the same, the Appeal Suit is dismissed as settled out of Court. The appellant is
entitled for refund of Court fee in accordance with the Rules. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
