ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the 2nd Respondent not to harass the petitioner and his family members as prayed by the petitioner in his complaint dated 12.03.2023.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that on the basis of the complaint given by the petitioner, enquiry has been undertaking. Even though the notice has been issued to the petitoner and the counter party, they did not appear before the respondent Police. Similarly, the counter complaint has been given by the third respondent herein and now both the complaints have been now enquired.

3. On the basis of the counter complaint only, notice was issued to the petitioner. When both of them have given complaint and counter complaint, they have to appear before the second respondent and share the informations that are available with them, since it is a civil issue. Depending upon the above said findings, the further enquiry may be 2/4

closed by the second respondent, after recording the statement of both the parties.

4. With the above said direction, this Criminal Original Petition is disposed of.
