Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To call for the records connected with the impugned order passed by the 3rd respondent in Na.Ka.No.35/Ni-2/2019, dated 23.05.2019, and quash the same and consequently direct the respondents to sanction the family benefit fund of Rs.3,00,000/- due to the death of the petitioners wife namely Sudha, in terms of G.O.Ms.No.57 Finance Department, 22.02.2016.

This contempt petition is filed against the order dated 15.11.2019 passed in W.P.(MD)No.19205 of 2019. The respondents preferred W.A.(MD)No.1477 of 2021 and the Hon'ble Division Bench modified the order and a direction was issued in the writ appeal and https://hcservices.ecourts.gov.in/hcservices/ 1/2
Cont.P.(MD)No.495 of 2020 allowed the writ appeal partly. Though the learned counsel for the petitioner states that the modification order is to be implemented, the contempt cannot be initiated in respect of the original order passed in the writ petition, as the Hon'ble Division Bench has already modified the order and allowed the writ appeal in part. Thus, the writ petitioner is at liberty to take appropriate steps. 2.With these observations, this contempt petition stands closed.
