ORDER

The present petition has been filed seeking a direction to the respondents to consider the petitioner's representation dated 02.02.2026 with regard to include the petitioner's name in the list victims/depositors/witness and expedite the investigation in Crime No.3 of 2023 on the file of the second respondent Police.

2.According to the petitioner, he had invested a sum of Rs.12,00,000/- and others have also invested the amount in M/S.Neo Max Properties Private Limited. According to the petitioner, based on his deposit receipt, he has already been shown as a witness in the charge sheet. He further submitted that as he had canvassed on behalf of the said company, some of his friends and relatives had also made deposits in the said company. However, they have not been shown as witnesses in the charge sheet. Therefore, the present petition has been filed seeking to include them as witnesses in the charge sheet on the basis of their deposit receipts.

3.The learned Additional Public Prosecutor, appearing for the respondent police, brought to the notice of this Court that, by order dated 19.09.2025 in Crl.O.P. (MD) No. 15498 of 2024 and batch, this Court, in paragraph No. 3, had specifically pointed out that any person seeking relief through Court should file a complaint on or before 08.10.2025. In such circumstances, the petitioner is canvassing on behalf of certain persons who have never lodged any complaint before the cut-off date.

4.Considering the fact that the petitioner's grievance has already been redressed by including him in the list of witnesses, insofar as the other persons for whom he is canvassing are concerned, they have never lodged any complaint before the cut-off date. Therefore, the question of acceding to the request of the petitioner does not arise.
