This petition has been filed to direct the Inspector of Police Muthaiahpuram Police Station Thoothukudi District to award adequate police protection so as to enable the petitioner to restore his compound wall in his property situated in survey No.316/1A 1. Mullakkadu Part I village Muthaiahpuram Thoothukudi.

2. It is the case of the petitioner that he is the owner of property in S.No.316/1A1, Mullakkadu Part I Village, Muthaiahpuram, Thoothukudi and that he wanted to restore the compound wall in the light of Civil Court judgment, one Mariraj / https://hcservices.ecourts.gov.in/hcservices/

R3 is objecting to it and preventing the petitioner from restoring the compound wall. In this regard, the petitioner has given a representation on 08.11.2016 and thereafter, filed the present writ petition.

3. Heard the learned counsel for the petitioner, the learned Government Advocate (Crl.Side) appearing for the State and perused the materials placed on record. Mr.N.Kumaresan, Special Sub-Inspector of Police, Muthaiahpuram Police Station, Thoothukudi District is present.

4. On instructions, the learned Government Advocate (Crl.Side) submitted that on the complaint given by the petitioner, a petition enquiry is pending and the Police have issued summons to the petitioner and Mariraj/R3 to appear for enquiry on 19.04.2017.

5. Recording the same, this petition is closed with further direction to the respondent police to conduct the enquiry by calling both the parties and take action in accordance with law by protecting the rights of the petitioner, if any.
