ORDER
(Order of the Court was made by DR.ANITA SUMANTH, J.) Petitioner seeks a mandamus directing the respondents to issue community certificates to his sons, D.Hariharan and D.Thirukumaran as Malai Vedan, Scheduled Tribe as per Scheduled Caste and Scheduled Tribe (Amendments) Act, 1976. This appeal petition No.9481 of 2017 is still pending. Counter has been filed by the Chairman State Level Scrutiny Committee/R1, wherein para 14 to 17 state as follows: "14.It is submitted that, on scrutiny of enquiry report, the SLSC observed that the Vigilance Cell has not conducted the enquiry in accordance with the procedure prescribed in G.O. (MS) No. 106, Adi Dravidar and Tribal Welfare Department dated 15.10.2012, such as the depositions of the family members, neighbourhood have not been collected and school/college records have not been furnished in respect of the individual's family members and moreover the Anthropologist report was also not available. Hence, the report was 2/5
reverted vide SLSC Letter No. 6298/CV/2(2)/2021; dated: 04.06.2024, to the Director, Tribal Welfare for conducting Re-enquiry in due manner.
15. It is submitted that SLSC ide letter dated:11.09.2025 has reminded the DSP to send the Re-enquiry report. In response, the DSP, SC/ST Vigilance Cell, Dindigul District vide his letter dated: 27.09.2025 has informed the SLSC stating that the Petitioner and his sons hac appeared for the enquiry on 18.09.2025 and have produced certain original documents. He has also summoned the headmaster of the petitioner's son's school, and his college principal, the petitioner' siblings vide his summon, dated:20.09.2025 and the authorities have appeared before the DSP for the enquiry and produced the documents. 16.Therefore, the DSP, SC/ST Vigilance Cell, Dindigul is conducting the enquiry, and collecting the connected records in support of his field enquiry, which is mandatory, for completion of verification process by the vigilance cell.
Hence, it is submitted that SLSC will pass final orders after obtaining the full-fledged vigilance cell report as mandated in G.O. (MS) No. 106, Adi Dravidar and Tribal Welfare Department, dated 15.10.2012." 2.There is a direction to R1 to dispose the appeal within the outer time limit of 90 days from today (ie.,07.11.2025), as the appeal is pending from 2017 onwards.
