ORDER : The Court Made the following order :- The petitioner / A1, who was arrested on 17.03.2017, for the offences punishable under Sections 417, 376 and 506(i) of IPC., on the file of the respondent police, seeks bail. 2.The case of the prosecution is that this petitioner has been arrested on 17.03.2017 based on the complaint lodged by one Lakshmi that the petitioner taking advantage of her loneliness and proximity of the relationship had forcibly raped her and thereafter promising to marry her had frequently indulged in sexual intercourse and impregnated her, when she asked him to marry, he refused to marry her.
3. The learned counsel for the petitioner submitted that the petitioner is the relative of the victim girl and both are majors and they have love affair with each other. He further submitted that the petitioner is an innocent person and with consent of the victim girl only the petitioner had sexual intercourse with her. The petitioner is falsely implicated in this case.
4. The learned Government Advocate (Crl.Side) submitted that the victim girl is now eight months pregnant and due to her pregnancy they are not able to conduct DNA test. https://hcservices.ecourts.gov.in/hcservices/
5. In the light of the above facts, this Court is not inclined
to grant bail to the petitioner. Hence this Criminal Original Petition is dismissed.
