Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A-7 to A-9, in Crime No.63 of 2017 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 294(b), 417, 376, 506(ii) of I.P.C and Section 4 of Tamilnadu Prohibition of Harassment of Women Act, 2002 and hence, seek anticipatory bail.
2.Heard the learned counsel for the petitioners and the learned Government Advocate(Crl. Side) for the respondent/State.
3. When the matter was taken up on 18.04.2017, it is submitted by the learned counsel for the petitioners that this Court already granted anticipatory bail to the petitioners with a direction to surrender before the Court below within 15 days. But due to unavoidable circumstances, the petitioners could not able to surrender before the Court below and hence, they have come up with this petition. On that day, this Court directed the petitioners to pay a sum of Rs.500/- for uprooting Karuvelam trees. Today, the petitioner has filed a cost memo along with receipt to prove that he has paid Rs.500/-.

4. The learned Government Advocate(Crl. Side) on instructions submitted that this is a case of love affair and the allegation is that the petitioners along with other accused abused the defacto complainant in filthy language.
5. Considering the facts and circumstances of the case and also considering the fact that the petitioners were already granted anticipatory bail by this Court in Crl.O.P(MD)No.3430 of 2017, dated 23.03.2017, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Manamadurai and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the first and second petitioner shall appear before the respondent police once in a week ie., on every Monday at 10.30 a.m., until further orders and the third petitioner shall appear before the respondent police as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
