: Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to sanction and disburse the family pension payable to the petitioner on the demise of her husband late Seeniappan immediately based on her representation dated 05.01.2018 submitted to the third respondent within a time frame to be fixed by this Court.

By consent of both parties, the writ petition is taken up for final disposal.

2.The petitioner's husband, namely, Seeniappan was employed in the Education Department. He retired from service and was getting pension.

https://hcservices.ecourts.gov.in/hcservices/ 3.The learned counsel appearing for the first respondent submitted that joint payment order was passed by the first

respondent. The petitioner's husband passed away on 06.10.2017. The pension payment order bears R1703925. Since the payment of family pension to the writ petitioner was stopped, this writ petition came to be filed.

4.There is no doubt that the petitioner is the wife of Late. Seeniappan, who was getting pension. After the death of the petitioner's husband, the petitioner had approached the third respondent for payment of family pension to her. But, unfortunately, the petitioner did not furnish the relevant details to the third respondent. Therefore, the third respondent did not arrange payment of family pension to the writ petitioner. Now, the particulars for payment of family pension has been furnished and the same has been duly incorporated in the order. Therefore, there cannot be any impediment for the third respondent to pay family pension to the writ petitioner. Hence, the third respondent is directed to pay the family pension to the writ petitioner together with arrears. Accordingly, this writ petition is allowed. No costs.
