To Condone the delay of 283 days in filing the Civil Miscellaneous Appeal against the order made in MCOP No.1302 of 2012 dated 11.01.2023 and thus render justice.

ORDER

This Petition is filed to condone the delay of 283 days in filing the the above appeal. 2.Heard the learned counsel appearing for the petitioner and perused the materials placed before this Court. There is no representation for the third respondent, despite printing the name of the second respondent in the cause list.

3.The learned counsel appearing for the third respondent raised an objection stating that the reason for the delay has not been sufficiently explained and also stated that the petitioner is not entitled for interest for the default period. 4.For the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is allowed on condition that the petitioner is not entitled for interest for the default period. 5.Registry is directed to number the appeal if it is otherwise in number. 07-11-2025 Ns To
