ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 2 and 3 to grant a No Objection Certificate (NOC) for the petitioner's land situated in Survey No.1232, Vadaveeranaikanpatti, Periyakulam Circle, Theni District, measuring 4492.5/8 sq. ft., and consequently, to grant patta based on the petitioner's representation dated 25.01.2024.

2. Heard the learned counsel appearing for the parties.

The learned counsel appearing for the petitioner submits that the petitioner is the owner of land in Survey No.1232, Vadaveeranaikanpatti, Periyakulam Circle, Theni District, measuring 4492.5/8 sq. ft. The petitioner submitted a representation dated 25.01.2024 requesting the respondents 2 and 3 to grant a No Objection Certificate (NOC) for the said land and to subsequently, issue the patta in the petitioner's name. Despite the representation, the respondents have not taken any action, thereby, causing unnecessary delay and

infringing upon the petitioner's statutory and legal rights. The respondents are duty-bound to consider the petitioner's representation on merits and in accordance with law and to grant the NOC and patta without further delay.

4. The learned Government Advocate appearing for the respondents submits that during the course of enquiry, a summon was issued to the petitioner. However, the petitioner did not participate in the enquiry and also did not submit any written submissions. For this reason, the proceedings could not be concluded.

5. At this juncture, the learned counsel for the petitioner submits that the petitioner will appear and produce all the relevant records for the purpose of obtaining the NOC and Patta within a period of two weeks from the date of receipt of a copy of this order.

6. In the event of filing all the relevant documents within the aforesaid time limit, the enquiry shall be concluded by the respondents 2 and 3 and appropriate orders shall be passed in accordance with law within a period of eight weeks thereafter. Needless to state, the adjudication of the Civil Court shall also be taken into account while passing such orders.
