ORDER : The Court Made the following order :- Petitioner/A2, who was arrested on 01.09.2016 for offences punishable under Sections 406, 419, 420, 368 r/w 34 and 109 IPC in Crime No.3 of 2003 on the file of respondent police, seeks bail.

2. The case of the prosecution is that petitioner impersonated the husband of A3 with her assistance and A1 and other accused obtained a loan of Rs.7,55,280/- from a cooperative bank.

3. Learned counsel for petitioner submitted that petitioner was unaware of the case since the case was registered in the year 2003 and petitioner went abroad in the year 2000. He adds that in a discharge petition filed by a co-accused the concerned Court while dismissing the same thought it fit to direct further investigation.

4. Learned Government Advocate (Crl. Side) vehemently oppose for grant of bail informing that the case is pending 10 long years and petitioner had been arrested on 13.08.2016 on his entry into India based on the issue of Red Corner Notice against him.

5. Considering the facts and circumstances of the case and also the fact that the petitioner has been in custody from 01.09.2016, this Court is inclined to release the petitioner on bail. Accordingly, the petitioner is ordered to be released on bail on her executing a bond in a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties each for the like sum to the satisfaction of https://hcservices.ecourts.gov.in/hcservices/

learned Judicial Magistrate No.II, CCIW, Special Court, Tirunelveli and on condition that the petitioner shall report before the respondent police daily at 10.00 a.m for a period of two weeks and thereafter as and when required.
