Criminal Original Petition is filed under section 439(1)(b) of Criminal Procedure Code, praying this Hon'ble Court to Modify the condition to appear before the Respondent police daily at 10 A.M for the Period of one month and there after once in 15 days until further order in Crl. M.P No. 484/2021 passed by the Special Court for E.C and NDPS Cases Pudukkottai dated 01.03.2021 in to appear before the Judicial Magistrate, No.I, Rameshwaram. CRL MP(MD). No.3412 of 2021 This petition has been filed to modify the condition directing the petitioner to appear before the respondent police daily at 10.00 a.m., for a period of one month and thereafter once in 15 days until further order as per the order passed by the Special Court for E.C and NDPS Act Cases, Madurai in Crl.M.P.No.484 of 2021 dated 01.03.2021.
2. Today, when the matter is taken up for hearing the learned Government Advocate(Crl.Side) appearing for the respondent submitted that the petitioner has not complied with the conditions even for a single day.
3. It appears that earlier the petitioner has filed a petition for modification of the same condition in Crl.O.P(MD) No.4185 of 2021 and the same was dismissed by this Court on 18.03.2021, thereafter also the petitioner has not complied with the condition. Since the earlier petition was dismissed on 18.03.2021, there is no reason to entertain the petition.
4. Hence the petition stands dismissed.
