ORDER

This petition has been filed seeking to transfer the investigation of the case in Crime No.10 of 2024 dated 09.01.2024 on the file of the second respondent police to the third respondent police or any other competent officer for fair and free investigation.

2. The learned counsel appearing for the petitioner submitted that the fourth respondent and his henchmen in the absence of the petitioner broke open and trespassed into the petitioner's hotel, damaged and stolen the articles therein, regarding which a First Information Report in Crime No.10 of 2024 came to be registered by the second respondent police for the offences under Sections 147, 448, 427 and 379 IPC and Section 3 of TN Public Property (Prevention of Damage and Loss) Act. However, 2/4

even after the registration of the FIR, there has been no progress in the investigation and hence, this petition came to be filed.

3. The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that after completion of investigation, the final report has been filed as 'mistake of fact'. He further submitted that the petitioner filed a private complaint and the same is pending before the Judicial Magistrate, Paramakudi.

4. Recording the aforesaid submissions made, this Criminal Original Petition is disposed of.
