ORDER
The present petition has been filed by A2 in C.C.No.43 of 2026 dated 26.11.2025 on the file of the learned Judicial Magistrate No.1, Tirunelveli, seeking to quash the final report in C.C.No.43 of 2026 dated 26.11.2025 on the 1/5
file of the learned Judicial Magistrate No.1, Tirunelveli, in Crime No.14 of 2024 dated 05.10.2024 on the file of the first respondent, wherein the petitioner has been charged for the offence under Sections 318(4) and 61(2) of BNS, 2023. 2.As per the case of the prosecution, the petitioner, along with other accused, had approached the second respondent, who is running a wholesale electrical shop, for the purchase of electrical goods. After purchasing the goods, the petitioner along with the others are alleged to have opened shops, sold the same, and failed to return the money to the second respondent, and thereafter closed the shops opened by them. According to the prosecution, right from the beginning, the petitioner had the intention to cheat the second respondent. In such circumstances, an FIR came to be registered, which culminated in the filing of the charge sheet.
3.According to the learned counsel appearing for the petitioner, he is in no way connected with the said offence and the first accused has already paid 50% of the amount that was demanded by the defacto complaint and therefore he seeks quashing of the charge sheet as against the petitioner/A2. 4.Heard both sides and perused the material records. 2/5
5.A perusal of the charge sheet reveals that a prima facie case has been made out as against the petitioner and therefore, this Court is not inclined to interfere at this stage especially when no legal grounds have been raised for quashing the charge sheet. The trial Court is directed to dispose of the case on merits without being influenced by any one of the observations made by this Court.
6.With the above said observations, this Criminal Original Petition stands dismissed. Consequently, the connected Criminal Miscellaneous Petition is closed.
