PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to grant No objection Certificate / License to extract water from bore well situated in my land bearing S.No.295/2 and S.No.295/4 comprised in Patta No.848 in Servaikaranmadam Village, Thoothukudi Taluk and District and transport the same to Thoothukudi Town on supplying to Residence, Institutions, Ice plants and Marriage halls with such condition as may be reasonable on consideration of my application dated 10.08.2022. The present Writ Petition has been filed seeking for a direction to the respondents to grant No objection Certificate / License to extract water from bore well situated in my land bearing S.No.295/2 and S.No.295/4 comprised in Patta No.848 in Servaikaranmadam Village, Thoothukudi Taluk and District and 2/6
transport the same to Thoothukudi Town for supplying to Residence, Institutions, Ice plants and Marriage halls by considering the petitioner's application dated 10.08.2022. 2.Learned Counsel for the petitioner would submit that the petitioner has already submitted an application on 10.08.2022, to the third respondent seeking No objection Certificate / License to extract water from bore well situated from the petitioner's land bearing S.No.295/2 and S.No.295/4 comprised in Patta No.848 in Servaikaranmadam Village, Thoothukudi Taluk and District. The said application has been duly forwarded by the third respondent to the second respondent and the same is pending consideration. 3.Learned Additional Government Pleader appearing for the respondents would submit that the respondents will dispose of the petitioner's application within a time frame to be stipulated by this Court.
4.Considering the submissions made by the learned Counsel on either side, this Writ Petition is disposed of, directing the respondents 1 & 2 to dispose of the petitioner's application dated 10.08.2022, for grant of license for extracting water from his lands, 3/6
within a period of two [2] weeks from the date of receipt of a copy of this order. It is made clear that the respondents 1 & 2 shall issue notice to the petitioner and all other persons concerned, hear them and thereafter, decide the issue and pass orders in accordance with law. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
