JUDGMENT

When the matter is taken up for hearing today, the learned Counsel for the appellant submitted that the sole appellant died and he is unable to get instructions with regard to the legal heirs of the deceased sole appellant and to set aside the abatement by bringing on record the legal heirs of the deceased sole appellant. He has also no objection to dismiss this appeal as abated.
