ORDER

This writ petition has been filed challenging the proceedings issued by the second respondent in C.No.C1/2113/2019 in R.O.O.No. 126/2019 dated 27.02.2019 thereby suspending the petitioner and the consequential order in C.No. C1/2113/2019 in R.O.O.No. 127/2019 dated 27.02.2019, not permitting the petitioner to retire from service.

2. Heard the learned counsel on either side and perused the materials placed before this Court.

3. When the matter was taken up for hearing, the learned Special Government Pleader appearing for the respondents submitted that as on date, no enquiry is pending against the petitioner and further, the criminal case registered against the petitioner was also over and the petitioner has been acquitted from the said criminal case and hence, necessary orders will be passed in this regard by the respondents.

4. In view of the aforesaid submission made, this Court directs the respondents to pass appropriate orders in the case of the petitioner, on merits and in accordance with law, within a period of two months from the date of 2/4

receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.

5. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
