PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.140 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) & 20(b)(ii)(B) of the Narcotic Drugs & Psychotropic Substances Act, 1985 in Crime No.140 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on receipt of secret information, the respondent police examined A1 & A2 and they found 1.150 kg of ganja and seized the same. During enquiry A1 & A2 stated that they have purchased the ganja from the petitioner herein. Hence, he has been arrayed as accused and a case came to be registered.

CRL OP(MD)No.5148 of 2023 3.Heard both sides and perused the materials available in the records.

4.It is seen that it is third petition for anticipatory bail. The first petition was dismissed on 20.12.2022 and the second petition was dismissed as withdrawn on 23.01.2023. There is no change in circumstances. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
