Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A-1 & A-2, in Crime No.4 of 2017 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 467, 468, 471, 420 and 506(i) of I.P.C and hence, seek anticipatory bail.
2.Heard the learned counsel for the petitioners and the learned Government Advocate(Crl. Side) for the respondent/State.
3. The learned Government Advocate(Crl. Side) on instructions submitted that the petitioners altered the caste name in the community certificate of their son and got admission in Vel Tech Engineering College. When the same was questioned by the defacto complainant, the petitioners threatened him with dire consequences.
4. The learned counsel appearing for the petitioners submitted that the petitioners/A-1 and A-2, are husband and wife and A-2 is the sister of the defacto complainant. He further submitted that with regard to partition of properties, there arose a dispute and due to that dispute, the defacto complainant had given a complaint before the respondent police stating that though the petitioners belonged to Backward Community, the petitioners had obtained https://hcservices.ecourts.gov.in/hcservices/
Scheduled Caste community certificate for their son and obtained admission in a college in Scheduled Caste quota.
5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.II, Virudhunagar and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
