ORDER

The revision petitioner / defendant filed this revision to set aside the order, dated 16.12.2021 passed in I.A.No.1 of 2021 in O.S.No.83 of 2016, on the file of the Additional Sub Court, Tenkasi.

2. Heard the learned counsel appearing for the petitioner. Since no adverse order passed against the respondent no notice is necessary to the respondent.

3. The suit is for recovery of money. Already, ex parte decree was passed in the year 2018 and thereafter, ex parte decree was set aside in I.A.No.893 of 2018. It is the second time ex parte decree petition and hence, the trial Court has directed the revision petitioner to deposit a sum of Rs.50,000/- on or before 21.12.2021. This Court does not find any valid reason to interfere with the order passed by the trial Court.

4. Accordingly, this Civil Revision Petition is dismissed by confirming the order, dated 16.12.2021 made in I.A.No.1 of 2021 in O.S.No.83 of 2016, on the file of the Additional Sub Court, Tenkasi. No costs.

5. The petitioner is directed to deposit the amount before the trial Court on or before 25.04.2022.
