ORDER

The Criminal Miscellaneous Petition has been filed seeking orders to permit the petitioner to withdraw the 30% of the cheque amount of Rs.2,40,000/-, which was deposited by the respondent to the credit of STC.No.80 of 2022 on the file of the Judicial Magistrate (Fast Track) Court, Uthamapalayam, pursuant to the order made in Crl.M.P.No.14588 of 2023 in Crl.RC(MD)No.1143 of 2023, dated 16.10.2023. 2.It is seen from the records that the petitioner has deposited 30% of the 1/3

compensation awarded by the learned Magistrate, while suspending the sentence imposed on the petitioner.

3.Considering the facts and circumstances of the case and also taking note of the fact that the respondent have deposited 30% of the compensation amount before the trial Court, this Court is inclined to grant permission to the petitioner. Hence, the petitioner is permitted to withdraw the deposited amount, on giving necessary undertaking before the trial Court. Accordingly, this petition is ordered.

4. Considering the submissions made on either side, the Registry is directed to place matter before the next Lok Adalat.
