ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(b), and 24(1) of COTP Act and section 77 of the Juvenile Justice Act, in Crime No.140 of 2026, on the file of 1/4

the respondent police, seeks anticipatory bail. 2.The petitioner is A2 in Crime No.140 of 2026 and A1 was his son. On 06.02.2016 at 08.a.m. When A1 was illegally possessed with banned Tobacco items and sold near the school premises, he was arrested. On his confession the investigating officer made a search in the shop owned by the petitioner. Then they found and recovered 96.750 kilograms of tobacco articles. According to the investigating agency they escaped from the scene of occurrence. Hence, they registered the above case for the alleged offence. 3.The learned counsel for the petitioner submitted that A1 was arrested and released on bail. The petitioner was not involved in the above said alleged offence.

4.The learned Government Advocate (Crl. Side) would submit that it is true that A1 was released on bail. But the allegation is that they have possessed with 96.75 kilograms of banned tobacco products, which is huge quantity. The petitioner has no previous case pending against him. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner. 2/4

5.Considering the rival submissions made on either side and also considering the quantity, this Court is not inclined to grant anticipatory bail to the petitioner.
