Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the first respondent to recover the award amount of Rs.6,70,160/- along with 12% interest from 17.03.2017 till date from the second respondent under Section 3(1) of the Revenue Recovery Act and as per the order passed by the Joint Commissioner of Labour (Tribunal), Tiruchirappalli, dated 02.07.2020.
ORDER:- Writ Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.N.Kamesh, Advocate for the Petitioner and of Mr.P.Subbaraj, Government Advocate On Behalf of the 1st Respondent and of Mr.C.Karthick, Advocate For the 2nd Respondent, this Court made the following order: This Writ Petition is listed today under the caption 'for reporting compliance'.
2.This Court, by order, dated 15.04.20221, allowed the Writ Petition directing the first respondent to recover the award amount along with interest at the rate of 12% p.a from 17.03.2017 till date from the second respondent within the time stipulated and deposit the same to the credit of E.C.O.P.No.59 of 2018 on the file of the Joint Commissioner of Labour, Tiruchirappalli and posted the matter today under the caption 'for reporting compliance'. 1/3
3.Today, Mr.C.Karthick, the learned counsel appearing for the second respondent submitted that an ex-parte award was passed and the second respondent had filed an application in I.A.No.18 of 2021 and the said I.A was posted on 19.04.2021. Due to the present pandemic situation, I.A was not taken up for hearing on that date. 4.However, Mr.C.Karthick, learned counsel appearing for the second respondent and Mr.P.Subbaraj, learned Government Advocate appearing for the first respondent submitted that a sum of Rs.9,42,836/- was deposited by the second respondent to the credit of E.C.O.P.No.59 of 2018, on the file of the Joint Commissioner of Labour, Tiruchirappalli and the order passed by this Court, on 15.04.2021, has been complied with.
