Writ Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned notice issued by the first respondent bearing Na.Ka.No.2402/A2/2017, dated 09.04.2018 and quash the same on the ground that the same is arbitrary, illegal and without any legal basis and consequently directing the first respondent to provide the personal hearing opportunity to submit the petitioner's further explanations. ORDER

The petitioner is the society registered under the Societies Registration Act, 1860. Because of some internal dispute, they were not in a position to submit the annual report and other accounts to the first respondent. Therefore, the first respondent has issued a show cause notice in proceedings Na.Ka.No.2402/A2/2017, dated 09.04.2018 granting 15 days' time, failing which, the registration will be cancelled. The petitioner had not submitted his explanation. Challenging the show cause notice, the petitioner is before this Court.

2. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate appearing for the first respondent.

3. Considering the submissions made by the learned Counsel appearing for the petitioner, this Court is inclined to extend the time for submitting the explanation by one month. The petitioner shall submit their explanation on or before 08.06.2018 and the first respondent is directed to consider the explanation submitted by the petitioner and pass orders in accordance with law within a period of one month thereafter.

4. With the above directions, the writ petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
