Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the second respondent to invoke his power under Section 68 of the Wakf Act, 2013 and thereby hand over the possession and records of the wakf namely Mohaideen Aandavar Pallivasal to the petitioner's committee and pass appropriate orders by considering the petitioner's representation dated 28.04.2018 within a time frame as fixed by this Court.

O R D E R

The petitioner is the newly elected office bearer, as per the election conducted by the Superintendent of Wakf Board/ Election Officer, Trichy. The election of seven persons has also been certified by the Tamil Nadu Wakf Board in their proceedings in Na.Ka.No.11795/16/Aa5/Pudugai, dated 19.04.2018. Since the old office bearers created problems without handing over charge as well as the documents, the petitioner has approached the second respondent for executing the same. The second respondent, in turn, by his letter dated 26.02.2018, directed the petitioner to produce the certified copy of the election results, within a period one week. The petitioner produced the same on 28.04.2018. Inspite of the same, no action has been taken by the second respondent.

2. Heard the learned Counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

Considering the submissions made by the learned counsel appearing for the petitioner and the learned Additional Government Pleader, a direction is issued to the second respondent to pass orders on the representation of the petitioner, dated 28.04.2018, within a period of one week from the date of receipt of a copy of this order.

With the above directions, the writ petition is disposed of. No costs.
