For Respondents : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PRAYER :- Petition filed under Section 482 of Cr.P.C to modify the condition (b) of the order dated 19.02.2020 passed in Crl.RC(MD) No.136 of 2020 as Judicial Magistrate, Musiri instead of Principal Sessions Judge, Trichy.

ORDER : The Court Made the following order :- The petition has been filed to modify the condition (b) of the order dated 19.02.2020 passed in Crl.RC(MD)No.136 of 2020 as Judicial Magistrate, Musiri instead of Principal Sessions Judge, Trichy.

2. The learned counsel appearing for the petitioner would submit that as against the order of the learned Principal District Judge, Trichy, in Cr.M.P.No.328 of 2020, dated 24.01.2020, the petitioner filed a Revision in Crl.R.C(MD)No.136 of 2020 and this Court while allowing the Revision imposed certain conditions. Now, the petitioner wants modify one of the conditions ie., Condition No.(b), which reads as, "b. The petitioner shall deposit a sum of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD). No.3169 of 2020 Rs.25,000/- (Rupees Twenty Five Thousand Only) to the credit of Crime No.224 of 2019, on the file of the learned Principal Sessions Judge, Tiruchirappalli, within a period of one week from the date of receipt of a copy of this order.".

3.Heard the learned counsel for the petitioner and the learned Government Advocate(Criminal Side) appearing for the State.

Admittedly, while allowing the Revision filed by the petitioner, for release of vehicle, this Court, of course, imposed certain conditions and the one of the conditions viz., condition No.b, which reads that, "b. The petitioner shall deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) to the credit of Crime No.224 of 2019, on the file of the learned Principal Sessions Judge, Tiruchirappalli, within a period of one week from the date of receipt of a copy of this order.". Now, the petitioner wants to modify the condition No.b, of the order dated 19.02.2020. 5.This Court does not find any justification in the contentions of the petitioner for modifying the condition No.(b) of the order dated 19.02.2020. Hence, this Criminal Miscellaneous Petition stands dismissed.
